1. Who we are and what this document is

ProDay is a notes, calendar and categories app, available at proday-fmm.web.app and as an installable app (PWA) and desktop app. It's offered by Fernando Mattar Modenese, referred to as "ProDay" or "we", contact proday.ly@gmail.com.

Paid plans are sold through Paddle, who acts as merchant of record. Billing, receipts and payment processing are their responsibility, not ProDay's directly.

By creating an account or using ProDay you agree to these Terms. If you don't agree, don't use the service.

2. What ProDay is, and what it is not

ProDay stores notes, categories, dates and photos you create, and syncs that content across the devices you sign into. It works with and without an internet connection: offline, what you write is saved on the device and syncs once you're back online.

ProDay isn't a dedicated backup service, nor a vault for sensitive documents with legal retention guarantees. Treat it the way you'd treat a notebook: the original is yours to keep.

3. Your account

• You need a valid email (or a Google account) to sign up.
• You're responsible for keeping your password secret and for anything that happens through your account.
• ProDay is intended for people 13 and older. If you're between 13 and 18, use it with a guardian's awareness.
• Tell us right away at proday.ly@gmail.com if you suspect unauthorized access to your account.

4. Plans

• Free: unlimited notes, categories, dates and photos, at no cost, indefinitely.
• Plus and Max (when available): paid plans with larger storage limits and AI features, billed monthly or annually through a third-party payment processor.
• The annual plan is charged once, at a discount on twelve months, and renews yearly until cancelled. Cancelling an annual plan after the first 7 days refunds the whole months not used -- see the Refund Policy.
• Prices and limits can change. A price change never affects a payment already made; for active subscriptions we give 30 days' notice before it applies to the next billing cycle.
• Cancellation, refunds, and any statutory withdrawal right are described in the Refund Policy.

5. Acceptable use

You agree not to:

• use ProDay to store or distribute illegal content;
• try to access another account's data, or bypass the service's security;
• use automation to overload the service (bots, bulk scraping);
• resell or redistribute access to ProDay without authorization.

Accounts that violate this may be suspended or terminated, with notice when possible.

6. Your content

Your notes, photos and categories are yours. ProDay doesn't claim ownership over what you write or upload. By using the service you grant us only the minimum license needed to store, process and sync that content across your devices, and nothing more. We don't use your note content to train AI models or for any purpose outside operating the service for you.

If and when optional AI features ship (summarizing a note, generating a checklist), they'll be off by default. Turning one on sends only the text of that specific operation to a provider processing it on our behalf, never the rest of your notes.

7. Availability and liability

ProDay is provided "as is". We do our best to keep it running and your data safe, but:

• we don't guarantee uninterrupted availability;
• we recommend using the built-in export periodically if your data is critical to you;
• to the extent the law allows, we're not liable for indirect damages arising from your use of the service.

Nothing here excludes liability that applicable consumer-protection law doesn't allow us to exclude.

8. Cancellation

You can delete your account at any time from the app's settings. This permanently removes your notes, categories and photos after the retention period described in the Privacy Policy. We may terminate accounts that violate section 5, with prior notice whenever possible.

9. Changes to these Terms

We may update these Terms. Material changes will be announced in the app or by email with reasonable notice before they take effect.

10. Governing law

These Terms are governed by Brazilian law. For Brazilian consumers, mandatory consumer-protection rules apply regardless of anything in this document.
